Welcome to LucyCool. These Terms of Service ("Terms") govern your access to and use of the LucyCool application, website, and services (collectively, the "Service") operated by LucyCool ("we", "us", or "our"), located in Strasbourg, France.

By accessing or using LucyCool, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the LucyCool application at https://app.lucycool.pro or the website at https://lucycool.pro, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 16 years of age to use LucyCool. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

LucyCool is a multi-platform video publishing application that allows users to:

• Connect their TikTok, YouTube, and Instagram accounts via official OAuth authentication.
• Upload video content through the LucyCool interface.
• Publish video content simultaneously to multiple connected social media platforms.
• Schedule publications for future dates and times.
• Track the status of their publications across platforms.

3. User Accounts

3.1 Account Creation

To use LucyCool, you must authenticate using a supported third-party provider (Google, TikTok, or Instagram/Meta). By authenticating, you authorize us to access certain account information as described in our Privacy Policy.

3.2 Account Security

You are responsible for maintaining the security of your account and any connected platform accounts. You must immediately notify us at alsacedev@gmail.com if you suspect any unauthorized access to your account.

3.3 Account Termination

You may disconnect your platform accounts and stop using the Service at any time. You may also request complete account deletion by contacting us at alsacedev@gmail.com.

4. User Responsibilities

By using LucyCool, you agree to the following:

4.1 Content Responsibility

• You are solely responsible for all content you upload and publish through LucyCool.
• You must own or have the legal right to distribute all content you publish.
• You must not upload or publish content that is illegal, defamatory, obscene, hateful, threatening, or that violates the rights of any third party (including intellectual property rights).
• You must not upload or publish content that contains malware, viruses, or any harmful code.

4.2 Platform Compliance

• You must comply with the terms of service and community guidelines of each platform you publish to, including but not limited to:
  • TikTok Terms of Service and Community Guidelines
  • YouTube Terms of Service and Community Guidelines
  • Instagram Terms of Use and Community Guidelines
• Violations of third-party platform rules are your sole responsibility. LucyCool is not liable for any consequences resulting from content you publish.

4.3 Prohibited Uses

You must not:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use the Service to distribute spam, unsolicited content, or engage in any form of platform manipulation.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use bots, scrapers, or automated tools to access the Service (other than through the intended application interface).
• Resell, sublicense, or redistribute access to the Service without our written consent.

5. Intellectual Property

5.1 Our Property

The LucyCool name, logo, website design, application code, and all associated intellectual property are owned by LucyCool. You may not use, copy, or distribute any part of the Service without our prior written consent.

5.2 Your Content

You retain full ownership of all content you upload and publish through LucyCool. By using the Service, you grant us a limited, temporary license to store and transmit your content solely for the purpose of providing the Service (i.e., publishing your videos to your selected platforms).

6. Account Suspension and Termination

We reserve the right to suspend or terminate your access to LucyCool at our sole discretion if:

• You violate these Terms of Service.
• You engage in activity that harms other users, the Service, or third-party platforms.
• You use the Service to publish content that is illegal or violates platform guidelines.
• Your account is flagged by a connected platform for policy violations.
• We are required to do so by law or regulation.

In the event of suspension or termination, we will make reasonable efforts to notify you via email. You may appeal a suspension by contacting us at alsacedev@gmail.com.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the Service will be uninterrupted, error-free, or that publications will be successfully delivered to all platforms at all times. Third-party platform APIs may experience downtime, rate limiting, or policy changes beyond our control.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of content, loss of followers, account suspensions on third-party platforms, or loss of revenue.
• Our total liability for any claims related to the Service shall not exceed the amount you paid to LucyCool in the 12 months preceding the claim, or 50 EUR, whichever is greater.

8. Third-Party Services

LucyCool integrates with third-party services (TikTok, YouTube/Google, Instagram/Meta). These integrations are governed by the respective terms of service of each platform. We are not responsible for:

• Changes to third-party APIs that may affect Service functionality.
• Third-party platform decisions regarding your account or content.
• Data processing by third-party platforms once your content has been published.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

10. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date at the top of this page and may notify you via email or through the application. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France and the European Union. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Strasbourg, France.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
